Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the DocksDeck marina-management software and website at docksdeck.com (the “Service”), provided by DocksDeck (“DocksDeck,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a marina or other organization, you represent that you have authority to bind that organization to these Terms.

The Service

DocksDeck provides software for marina operators to manage slip reservations, occupancy, boater records, and related operations. Features may change over time as we improve the Service.

Accounts

You must provide accurate information and keep your account secure. You are responsible for activity that occurs under your account and for the accounts of staff you invite. Notify us promptly of any unauthorized use.

Subscriptions, trials, and payment

  • The Service is offered on a subscription basis at the price shown on our pricing page. New marinas may start with a free trial; at the end of the trial a payment method is required to continue.
  • Subscriptions are billed in advance on a recurring basis through our payment processor, Stripe, and renew automatically until canceled.
  • You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
  • Card processing fees charged by Stripe for payments your boaters make to you are between you and Stripe. DocksDeck does not take a commission on your bookings.

Your data and content

You retain all rights to the data and content you and your boaters submit to the Service (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide and support the Service. You are responsible for the accuracy of Customer Data and for having the necessary rights and consents to provide it, including any personal information about your boaters. Our handling of personal information is described in our Privacy Policy.

Acceptable use

You agree not to:

  • use the Service in violation of any law or the rights of others;
  • upload malicious code or attempt to disrupt or gain unauthorized access to the Service or other users’ data;
  • reverse engineer, resell, or copy the Service except as permitted by law;
  • use the Service to send unsolicited communications in violation of applicable law.

Third-party services

The Service integrates with third parties such as Stripe (payments), Google Cloud and Firebase (hosting and authentication), and Resend (email). Your use of those services may be subject to their own terms, and we are not responsible for third-party services.

Intellectual property

The Service, including its software, design, and trademarks, is owned by DocksDeck and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, DocksDeck will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends; provisions that by their nature should survive will survive.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide additional notice where appropriate. Continued use of the Service after changes take effect constitutes acceptance.
